1723 charsCroatia's Financial Services Regulator Publishes Active Account Reporting Clarifications Under EMIR
On July 27, 2026, the Croatian Financial Services Supervisory Agency (Hanfa) announced that the European Securities and Markets Authority (ESMA) published updated Active Account Requirement (AAR) reporting instructions under Article 7b of Regulation (EU) No 648/2012 on OTC derivatives, central counterparties and trade repositories (EMIR).
The updated AAR reporting instructions provide additional clarifications regarding the reporting process and completion of specific data fields. ESMA amended the README, INSTRUCTIONS, and Guidance_Most_Relevant_Subcats worksheets contained in the AAR reporting instructions, with a summary of all amendments included in the Update worksheet alongside a comparison against the previously published version. The AAR reporting templates themselves remain unchanged.
Hanfa reminded market participants that counterparties becoming subject to the Active Account Requirement must notify their competent national authority and ESMA in accordance with Article 7a of EMIR. Under the Act on the Implementation of Regulation (EU) No 648/2012 on OTC Derivatives, Central Counterparties and Trade Repositories (Official Gazette No 59/2026), which entered into force on June 17, 2026, Hanfa is the competent national authority in Croatia responsible for supervising compliance with the Active Account Requirement. Information on the notification procedure, relevant notification forms, and instructions for submitting reports to Hanfa are available on Hanfa's website under the EMIR section. The deadline for submitting the first report is July 31, 2026. Market participants can access the updated AAR reporting instructions on ESMA's website in the Data Reporting section under EMIR Reporting.
