European Banking Authority Consults on Reporting Framework for Initial Margin Model Validation

On August 5, 2026, the European Banking Authority (EBA) launched a consultation on a new reporting framework to support the validation and ongoing monitoring of initial margin models based on the Standard Initial Margin Model (SIMM) developed by the International Swaps and Derivatives Association (ISDA). Since March 1, 2026, the EBA has served as the central validator of pro forma initial margin models under the European Market Infrastructure Regulation (EMIR), as amended by Regulation (EU) 2024/2987 (EMIR 3). The proposed reporting requirements will enable the EBA to perform this validation role effectively while ensuring a proportionate approach for reporting entities. The framework will collect consistent, high-quality information on the use and performance of initial margin models and provide data necessary to calculate annual fees associated with pro forma model validation. A key feature of the proposal emphasises proportionality. The EBA has designed the scope, content, and frequency of reporting requirements to provide effective oversight while minimising compliance costs. Firms with less significant over-the-counter (OTC) trading activities will face substantially lighter reporting obligations, with annual reporting required only once per year. The framework will enable the EBA and competent authorities to monitor initial margin models for non-centrally cleared OTC derivative contracts used by financial counterparties and non-financial counterparties subject to initial margin requirements. The consultation period closes on November 2, 2026, and stakeholders can submit comments via the EBA's consultation page. Following consideration of feedback, the EBA intends to adopt a Decision by the end of 2026 establishing the information collection framework. The first reporting reference date is expected to be December 2027, with data collection occurring in the first quarter of 2028. The new requirements will be incorporated into EBA technical package version 4.4, Phase 2, with the final technical package expected in March 2027.
