On July 27, 2026, Poland's Official Journal published the Act on Artificial Intelligence Systems (Ustawa o systemach sztucznej inteligencji), implementing the European Union's AI Regulation (EU) 2024/1689. The legislation, enacted July 3, 2026, establishes the Commission for Artificial Intelligence Development and Security (Komisja Rozwoju i Bezpieczeństwa Sztucznej Inteligencji) as Poland's primary market surveillance authority for AI systems and general-purpose AI models. The Commission will oversee compliance with EU AI Regulation requirements, manage market surveillance, support AI innovation and research competitiveness, and coordinate with national authorities and EU institutions. The legislation grants the Commission authority to conduct inspections, issue warnings, impose administrative penalties, and establish regulatory sandboxes. The Commission comprises a Chair, two Deputy Chairs, and four members appointed by the Office for Competition Protection, Financial Supervision Commission, National Broadcasting Council, and Electronic Communications Office. The Act establishes procedures for individual opinions on AI regulation compliance, with a 150 zloty application fee. Opinions are binding on the Commission and other state bodies for specified factual circumstances. The legislation also creates a Social Council for Artificial Intelligence to advise the Commission and enables the Commission to establish regulatory sandboxes supporting AI development through exemptions or compliance support. Participants include micro, small, and medium enterprises at no cost, while other entities pay scaled fees. The Act designates the Minister for Digitization as the notifying authority for conformity assessment bodies and grants the Commission enforcement powers including administrative penalties, system withdrawal orders, and immediate execution authority for decisions protecting public safety. The legislation enters into force August 10, 2026, with Chapter 3-5, 8, and 9 effective October 10, 2026.
