European Banking Authority Consults on Regulatory Technical Standards for Deposit Guarantee Scheme Payouts

On July 23, 2026, the European Banking Authority (EBA) launched a consultation on Regulatory Technical Standards (RTS) governing payouts of client funds deposits under the Deposit Guarantee Schemes Directive (DGSD). The consultation aims to establish harmonised rules across the European Union to further improve depositor protection mechanisms. The RTS will set out technical requirements for how deposit guarantee schemes must process and execute payouts to depositors when a credit institution fails. This includes establishing clear procedures, timelines, and operational standards that deposit guarantee scheme administrators must follow to ensure consistent and efficient compensation of eligible deposits across member states. The standards will address key operational aspects including verification of depositor claims, calculation of payable amounts, and the mechanics of fund distribution. By establishing these technical standards, the EBA seeks to enhance the speed and reliability of depositor compensation, reducing uncertainty and strengthening confidence in the EU banking system. The consultation is particularly significant given the revised DGSD framework, which has introduced enhanced protections and updated requirements for deposit guarantee schemes operating across the EU. The consultation period runs from July 23, 2026 to October 23, 2026, with responses due by 23:59 on October 23, 2026. Stakeholders, including credit institutions, deposit guarantee scheme administrators, and other interested parties, are invited to submit their feedback on the proposed RTS. All contributions received will be published following the consultation closure, unless respondents request confidentiality. The consultation paper and draft RTS are available on the EBA website.

The EBA proposes that the draft RTS: Require credit institutions to ensure they receive accurate and complete client-level information from financial institutions by means of contractual arrangements with those financial institutions or other means permitted under national law, including for stress testing to ensure accurate protection of clients who are beneficiaries of client funds deposits. Include provisions to ensure that the transmission of personal information from the financial institutions to the credit institutions and then to the DGS does not create competition issues for the financial institutions or data protection issues for the clients. Require the transmission of that information to the DGS in accordance with templates and procedures set by the DGS. Establish the criteria that result in a repayment to be made to the account holder for the benefit of each client, unless specific circumstances apply in which direct repayment to the client is required to ensure adequate depositor protection. Establish coordination, communication and confirmation requirements between the DGS, the financial institution and the relevant body representing the credit institution, to prevent multiple claims or duplicate repayments to the same beneficiary in the case of bank insolvency. Comments and feedback are welcome up until October 23, 2026.
