1664 charsFrance's Prudential Supervision and Resolution Authority Aligns with European Banking Authority Guidelines
On July 23, 2026, the Autorité de contrôle prudentiel et de résolution (ACPR), France's prudential regulator, declared its compliance with European Banking Authority (EBA) guidelines (EBA/GL/2026/01) that clarify criteria for identifying activities under Article 4(1)(18) of Regulation (EU) No. 575/2013.
The EBA guidelines establish standardised criteria for identifying specific activities that fall within the scope of the Capital Requirements Regulation (CRR). By declaring compliance, the ACPR commits to implementing and enforcing these guidelines across all institutions under its direct supervision. The guidelines apply to all credit institutions, investment firms, and other entities regulated by the ACPR. These organisations must take all necessary steps to comply with the guidelines in accordance with Article 16 of Regulation (EU) No. 1093/2010, which established the EBA as the EU's banking regulator.
The ACPR's alignment with the EBA guidelines ensures consistency in how French prudential authorities identify and classify regulated activities across the EU banking sector. This harmonisation supports a level playing field for financial institutions operating across member states and strengthens prudential oversight by applying uniform standards for activity classification.
All institutions under the ACPR's direct supervision must ensure full compliance with the EBA guidelines. The ACPR has published a notice confirming its adoption of these guidelines, which are now binding on supervised entities. Institutions should review their operations to confirm alignment with the activity identification criteria set out in the EBA guidance.

1219 charsFrance's Prudential Supervision and Resolution Authority Adopts EBA Guidelines on Ancillary Service Undertakings
On July 23, 2026, the Prudential Supervision and Resolution Authority (ACPR) announced it had adopted the European Banking Authority’s (EBA) Guidelines that clarify criteria for identifying activities under Article 4(1)(18) of Regulation (EU) No. 575/2013 ( EBA/GL/2026/01 ).
The EBA guidelines establish clear, simple and consistent criteria for the identification of activities that fall under the definition of ancillary service undertakings in accordance with Article 4(1)(18) of Regulation (EU) No. 575/2013 . By declaring compliance, the ACPR commits to implementing and enforcing these guidelines across all institutions under its direct supervision. The guidelines apply to all credit institutions, investment firms and other entities regulated by the ACPR.
All institutions under the ACPR's direct supervision must ensure full compliance with the EBA guidelines.
The ACPR also confirms that the guidelines are extended to cover finance companies that do not fall within the definition of “financial institutions” referred to in Article 4(1) of Regulation (EU) No. 1093/2010, but to which the requirements of Directive 2013/36/EU and Regulation (EU) No 575/2013 apply.
The guidelines apply from May 4, 2026.
