2132 charsEuropean Union Commission Publishes Implementing Technical Standards for Insider List Formats
On June 12, 2026, the European Commission published Commission Implementing Regulation (EU) 2026/1291, which establishes implementing technical standards for the format of insider lists under the Market Abuse Regulation (Regulation (EU) No 596/2014). The regulation repeals Commission Implementing Regulation (EU) 2022/1210 and introduces a revised framework for how entities maintain and update insider lists.
The regulation applies to issuers, emission allowance market participants, auction platforms, auctioneers, auction monitors, and any persons acting on their behalf who are required to maintain lists of individuals with access to inside information. The new standards introduce an "alleviated format" previously applicable only to certain small and medium-sized enterprise (SME) growth market issuers, now extending it to all insider lists to reduce administrative burden. The regulation establishes two primary templates: Template 1 for event-based sections identifying specific pieces of inside information with details on when individuals obtained and ceased access, and Template 2 for permanent insiders who have access to all inside information at all times. For SME growth market issuers, Template 3 applies, listing only those with regular access to inside information. The regulation requires entities to maintain insider lists in electronic form ensuring restricted access, accuracy, and confidentiality, with competent authorities specifying transmission methods. Personal data retention is limited to five years after an individual ceases to be on the insider list. The regulation respects fundamental rights under the Charter of Fundamental Rights of the European Union and complies with the General Data Protection Regulation (Regulation (EU) 2016/679). The European Securities and Markets Authority (ESMA) conducted public consultations on the draft standards and consulted its Securities Markets Stakeholder Group.
The regulation enters into force on the twentieth day following its publication in the Official Journal of the European Union and is binding and directly applicable across all member states.
