1526 charsLuxembourg Enacts Law Modifying Financial Sector Legislation and Transposing European Union Directives on Banking Supervision and Derivatives Markets
On May 5, 2026, Luxembourg enacted a law modifying and transposing several European Union directives and regulations relating to financial services supervision and derivatives markets. The law, published in the Mémorial A n° 227 of 2026, amends four key pieces of Luxembourg legislation: the law of April 5, 1993 on the financial sector; the law of December 17, 2010 on collective investment undertakings; the law of December 18, 2015 on resolution and liquidation measures for credit institutions and certain investment firms; and the law of March 15, 2016 on over-the-counter derivatives, central counterparties, and central repositories.
The law transposes Directive (EU) 2024/1619, which amends Directive 2013/36/UE regarding supervisory powers, sanctions, third-country branches, and environmental, social and governance risks. It also transposes Directive (EU) 2024/2994, which modifies directives 2009/65/CE, 2013/36/UE, and (EU) 2019/2034 concerning concentration risk from central counterparty exposures and counterparty risk from centrally cleared derivatives transactions.
Additionally, the law implements Regulation (EU) 2024/2987, which amends regulations (EU) 648/2012, (EU) 575/2013, and (EU) 2017/1131 to mitigate excessive exposures to third-country central counterparties and improve efficiency of the Union's clearing markets. These measures affect credit institutions, investment firms, collective investment undertakings, and other financial service providers operating in Luxembourg's financial sector.
