European Banking Authority Publishes Final Guidelines on Supervisory Independence

On 29 April 2026, the European Banking Authority (EBA) published its final Guidelines on Supervisory Independence under the Capital Requirements Directive (CRD). The Guidelines clarify the arrangements that competent authorities must establish to prevent and manage conflicts of interest involving staff and governance body members. The Guidelines address key areas of supervisory independence through harmonised standards. They establish minimum requirements for declarations of interest to be submitted on a pre-employment, annual and ad-hoc basis. The Guidelines specify procedural requirements for the sale or disposal of financial instruments that may create conflicts of interest and further define the prohibition on trading in financial instruments under the CRD. Additionally, they provide procedures and assessment criteria for competent authorities to determine appropriate cooling-off periods where national laws permit periods beyond the minimum set out in the CRD, ensuring a proportionate and consistent approach across the European Union. The Guidelines also clarify arrangements related to the appointment of members of governance bodies and the duration of their tenure to safeguard trust in the governance of competent authorities and ensure transparency of procedures. These measures aim to strengthen the framework for managing risks to supervisory independence, which pose challenges to the soundness of supervision and good governance. The Guidelines have been developed pursuant to Article 4a(9) of Directive 2013/36/EU and build on existing EU and international standards and principles related to supervisory independence and conflict of interest management, including the Joint European Supervisory Independence criteria published on 25 October 2023. The final report is available on the EBA website and is currently awaiting translation into the EU official languages.
