1398 charsBelgium's Financial Services and Markets Authority Announces Implementation of Banker's Oath for Banking Service Providers
On 15 July 2026, the Financial Services and Markets Authority (FSMA) will implement the banker's oath requirement for banking service providers working at banking and investment services agents for credit institutions in Belgium.
The oath will apply to four categories of persons: senior management members (category 1); managers responsible for supervising other banking service providers (category 2); banking and investment services agents registered with the FSMA as natural persons (category 3); and all other persons who directly participate in the exercise of banking activities or services at the agent (category 4).
The FSMA has published a newsletter addressing key implementation matters, including where banking service providers must swear the oath, what information about banking service providers must be registered, and additional guidance on the banker's oath requirements. The newsletter is available in Dutch and French only.
Banking and investment services agents and credit institutions should ensure their personnel are aware of the July 2026 effective date and prepare for compliance with the oath requirement. Further details and guidance are available through the FSMA's official communications and newsletter.

Credit institutions are required to provide the FSMA with a list of banking service providers active within their organisation or within their banking and investment service agents every six months.
The FSMA has published a series of FAQs on its website to help relevant stakeholders better understand what the banker’s oath entails. Further questions can be sent to the FSMA’s Banking Oath Management unit via email at sbe@fsma.be .
