TITLE: Netherlands' Financial Markets Authority Fines Vodafone Financial Services for Irresponsible Credit Distribution

On July 15, 2024, the Dutch Authority for the Financial Markets (AFM) imposed an administrative fine of €375,000 on Vodafone Financial Services B.V. (Vodafone FS) for providing credit to consumers without proper justification. The Rotterdam District Court reduced this fine to €185,000 on June 18, 2026, based on the severity and duration of the breach, culpability, and a five-month procedural delay.
The violation occurred in August 2022 when a software error in Vodafone FS's ordering process caused the company to bypass income and expenditure assessments (ILT) for 158 customers seeking telecom credit—loans provided for purchasing mobile phones with subscription contracts. Under Dutch financial services law, credit providers must conduct an ILT for all credit agreements exceeding €250 to protect consumers against over-indebtedness by verifying income, expenses, and existing debts. Vodafone FS identified and reported the software error to the AFM, and subsequently compensated all affected customers by cancelling their credits while allowing them to retain their phones.
This violation was not isolated. Vodafone FS received a warning letter from the AFM in July 2018 for failing to conduct income and expenditure assessments, and a second warning in March 2022 for over-indebtedness resulting from two separate incidents. The AFM had explicitly urged Vodafone FS to implement sufficient preventive measures, yet the breach recurred within six months. The AFM initially calculated a base fine of €2,500,000 but substantially reduced it to €375,000, citing the limited scope of the breach, restricted customer impact, and Vodafone FS's cooperative response following discovery of the error. The Rotterdam court's subsequent reduction reflected procedural fairness considerations.
