The NBU issued formal written warnings to two named payment service providers for identified regulatory violations, which constitutes a formal enforcement action.
Mandatory inheritance: Warning is a child of Enforcement, so Enforcement must be raised as the secondary tag.
Product
The update concerns enforcement actions against payment service providers for violations of capital and risk management requirements, but does not specify which retail payment products (e.g., credit transfers, direct debits, debit cards) are affected.
Payment service providers typically offer multiple payment products; direct debits represent another common payment service, but the update provides no product-specific detail to justify either tag with confidence.
Obligation
The NBU's enforcement action mandates that both payment service providers take corrective measures within 30 days to remedy identified violations in capital requirements and internal control systems, which constitutes a Controls Implementation obligation to design and deploy practical preventive measures.
The enforcement measures were triggered by the NBU's remote supervision activities that identified deficiencies in risk control and management procedures, reflecting an underlying Monitoring obligation that detected the violations.
Activity
The enforcement action addresses violations of regulatory capital requirements and internal control/risk management deficiencies at payment service providers, which are foundational prudential obligations that underpin multiple payment service activities but do not directly target a specific business activity.
The violations concern risk management and capital adequacy frameworks applicable to payment service providers generally, which could relate to transaction monitoring or fraud prevention controls, but the enforcement notice does not specify which payment activities were deficient.
Themes
The enforcement action targets payment service providers' breaches of regulatory capital requirements and internal control deficiencies, which are core prudential safety-and-soundness obligations.
The violations also include failures to establish adequate internal control systems and risk management procedures, which reflect operational and governance resilience expectations for payment service providers.
Functions
The enforcement action targets violations of regulatory capital requirements and internal control/risk management procedures, which are core Risk function responsibilities for overseeing the framework for identifying, assessing and managing material risks in financial services.
Compliance functions must interpret the NBU's enforcement findings and ensure the payment service providers implement corrective measures within the 30-day remediation window to address regulatory violations.

TITLE: Ukraine's National Bank Applies Enforcement Measures Against Two Payment Service Providers
BODY:
On August 14, 2026, the National Bank of Ukraine (NBU) applied enforcement measures in the form of written warnings to two payment service providers: LLC "PC HERTZ" (registration number 39763909) and LLC "EUROPEAN PAYMENT SYSTEM" (registration number 39269220). The NBU's Supervisory and Regulatory Committee for Banks and Payment Infrastructure Oversight adopted these decisions on August 13, 2026.
The enforcement measures address violations of payment market legislation, specifically breaches of regulatory capital requirements and failures to establish and maintain adequate internal control systems and risk management procedures. The NBU identified violations during remote supervision activities concerning non-compliance with prudential standards and deficiencies in risk control and management.
The violations relate to the Law of Ukraine "On Payment Services"; the NBU Board Resolution No. 123 from October 10, 2024, establishing management system requirements for financial payment service providers; the NBU Board Resolution No. 217 from October 7, 2022, governing authorisation procedures for financial and limited payment service providers; and the NBU Board Resolution No. 64 from June 13, 2025, addressing regulatory capital requirements for non-bank payment service providers.
Both payment service providers must take corrective measures within 30 calendar days from receiving the Committee's decisions to remedy the identified violations and prevent future non-compliance with payment market legislation. The enforcement action reflects the NBU's ongoing supervisory efforts to ensure compliance with regulatory standards across Ukraine's payment services sector.
