Loading... 2026/222 Russia Sanctions Amendment Regulations (No 3) 2026 Cindy Kiro, Governor-General Order in Council At Wellington this 3rd day of August 2026 Present: Her Excellency the Governor-General in Council These regulations are made under section 9 of the Russia Sanctions Act 2022 — (a) on the advice and with the consent of the Executive Council; and (b) on the recommendation of the Minister of Foreign Affairs made in accordance with section 8 of that Act. (2) Part 2 of these regulations comes into force on 3 September 2026. 3 Principal regulations These regulations amend the Russia Sanctions Regulations 2022 . Part 1 Amendments commencing on 7 August 2026 4 Part 1 of table in Schedule 2 amended In Schedule 2 , table, Part 1, insert in their appropriate alphabetical order the items set out in Part 1 of the Schedule of these regulations. 5 Part 2 of table in Schedule 2 amended (1) In Schedule 2 , table, Part 2, insert in their appropriate alphabetical order the items set out in Part 2 of the Schedule of these regulations. (2) In Schedule 2 , table, Part 2, revoke the item relating to Tatiana Vladimirovna Evtushenkova. Part 2 Amendments commencing on 3 September 2026 6 Regulation 4 amended (Designated persons, designated assets, and designated services) (1) In regulation 4(1)(b) , replace “10(2) and (3)” with “10(2), (3), and (3A),” . (2) In regulation 4(1)(c) , replace “11(2)(b) and (c)” with “11(2)” . 7 Regulation 5 amended (Interpretation) (1) In regulation 5(1) , revoke the definitions of associate , relative , and senior manager . (2) In regulation 5(1) , insert in its appropriate alphabetical order: associated entity , in relation to a person, has the meaning set out in subclause (2) (3) Replace regulation 5(2) with: (2) In these regulations, a person ( person A ) is an associated entity of another person ( person B ) if person A is an entity owned or controlled by person B. (4) In regulation 5(3) , replace “ person D ” with “ person C ” . (5) In regulation 5(3)(a) and (b) , replace “person D” with “person C” . (6) Revoke regulation 5(4) . 8 Regulation 10 amended (Prohibition on dealing with assets of, or for benefit of, sanctioned persons) (1) In the heading to regulation 10 , delete “ of, or for benefit of, sanctioned persons ” . (2) In regulation 10(1)(b) , replace “(2) or (3)” with “(2), (3), or (3A)” . (3) After regulation 10(3)(b) , insert: (c) would be for the purpose of evading or circumventing a sanction. (4) After regulation 10(3) , insert: (3A) A New Zealand person must not deal with a ship that is listed in Schedule 6, unless the circumstances set out in regulation 8(4)(a) or (b) apply. 9 Regulation 10A amended (Prohibition on dealing with securities of sanctioned persons) After regulation 10A(2)(c) , insert: (d) would be for the purpose of evading or circumventing a sanction. 10 Regulation 11 amended (Prohibition on dealing with services) (1) After regulation 11(2)(c) , insert: (d) a service if that dealing is for the purpose of evading or circumventing a sanction. (2) In regulation 11(3)(a) , replace “(2)(b) does” with “(2)(b) and (d) do” . (3) In regulation 11(3)(b) , replace “(2)(b)” with “(2)(b) and (d)” . 11 Regulation 12 amended (Sanctions on assets and services do not apply in certain circumstances) (1) After regulation 12(6) , insert: (6A) A New Zealand person that is a bank may charge, and receive money, for the payment of normal service charges, including arrears and administrative fees, in relation to a restricted asset if the sanctioned person to whom the asset relates held the asset immediately before the relevant date. (2) In regulation 12(8) , definition of restricted asset , replace “10(2) or (3)” with “10(2), (3), or (3A)” . 12 Part 3 of table in Schedule 2 amended (1) In Schedule 2 , table, Part 3, replace “associate” with “associated entity” in each place. (2) In Schedule 2 , table, Part 3, revoke the items relating to— (a) a relative of a person listed in Part 2 of this schedule as a person sanctioned by regulation 8 ; and (b) a relative of a person listed in Part 2 of this schedule as a person sanctioned by regulation 9 ; and (c) a relative of a person listed in Part 2 of this schedule as a person sanctioned by regulation 10 ; and (d) a relative of a person listed in Part 2 of this schedule as a person sanctioned by regulation 10A . 13 Schedule 3 amended In Schedule 3 , table, revoke the items relating to— (a) 30.05; and (b) 4016.93.00; and (c) 7320.20; and (d) 90.18; and (e) 9019.20.00; and (f) 90.22; and (g) 94.02. 14 Schedule 6 amended In the Schedule 6 heading, after “8(1)(c),” , insert “10(3A),” . Explanatory note This note is not part of the regulations but is intended to indicate their general effect. These regulations amend the Russia Sanctions Regulations 2022 (the principal regulations ). Parts 1 and 2 of these regulations come into force on 7 August 2026 and 3 September 2026, respectively. All the amendments fulfil the purpose of the principal regulations, which is to give effect to the Russia Sanctions Act 2022 by imposing sanctions in response to Russia’s military actions in relation to Ukraine (and in response to any assistance given to Russia from any other country or person in connection with those actions). Part 1 of these regulations— adds the names of entities so that the sanctions regime applies to them ( regulation 4 ): adds the names of individuals so that the sanctions regime applies to them ( regulation 5 ). Those added entities and individuals are— actors that contribute to Russia’s malicious cyber activity targeting Ukraine and its supporters; and actors contributing to Russia’s military-industrial complex; and actors that are involved in the forced relocation, re-education, and militarisation of Ukrainian children; and Russian political actors; and actors from the Democratic People’s Republic of Korea who have provided military assistance to Russia’s invasion of Ukraine; and an actor from Iran that has facilitated the production of military equipment for Russia’s invasion of Ukraine. Part 2 makes substantive amendments to the principal regulations. In particular, those amendments— remove the automatic application of sanctions to relatives and individuals who are associates of sanctioned persons ( regulations 7 and 12 ): prohibit dealings with assets and services that are for the purpose of circumventing sanctions ( regulations 8 to 10 ): prohibit dealings with ships listed in Schedule 6 of the principal regulations ( regulation 8(4) ): add an exception to enable New Zealand banks to charge and collect normal service charges in relation to a sanctioned bank account ( regulation 11 ): remove the export prohibition in relation to some medical devices specified in Schedule 3 of the principal regulations ( regulation 13 ).
