TITLE: South Korea's Financial Services Commission Expands Internal Control Requirements for Electronic Financial Businesses BODY: On July 31, 2026, the Financial Services Commission (FSC) approved amendments to the Financial Conglomerate Supervision Regulation (금융복합기업집단 감독규정) at its 14th regular meeting. The amendments expand the scope of internal control and risk management requirements to include all electronic financial businesses within financial conglomerates, regardless of their industry classification. Previously, electronic financial businesses that did not fall under the Korean Standard Industrial Classification (KSIC) category of "finance and insurance" were excluded from the definition of affiliated financial companies under financial conglomerate regulations. This created inconsistent treatment among electronic financial businesses, with some subject to group-level internal control and risk management requirements while others were not. The FSC identified this gap as particularly significant given the growing influence of fintech and big tech companies, which increasingly operate across multiple financial services—including both licensed financial businesses and electronic financial services—creating interconnectedness and operational risks that could transmit across group entities. The amended regulation now includes all electronic financial businesses as affiliated financial companies under financial conglomerate law, eliminating regulatory arbitrage and ensuring comprehensive group-level risk management. This change applies uniformly to all electronic financial businesses, regardless of their KSIC classification. The FSC expects the amendments to enhance the effectiveness of internal control and risk management at the conglomerate level, improve sound management practices, and strengthen consumer protection. The FSC indicated it will continue to refine the financial conglomerate regulatory framework in response to evolving market conditions.
