Company responsibility SPA assigned the penalty to Blaze, and not to the influencer João Caetano, because the company is responsible for complying with legal regulations and overseeing the entire commercial distribution chain. The influencer has over 15 million followers on YouTube and 3 million on Instagram. Blaze claimed in the lawsuit that it terminated the contract with the influencer as soon as it became aware of the irregularities. However, the regulatory body rejected this argument. According to SPA, the contract stipulated adherence to a... briefing and to standards defined by the betting company itself, which indicated that the influencer acted under the direct coordination and control of Blaze, and not autonomously. The department also highlighted that the 33 irregular videos remained online for four months, demonstrating a failure in the company's duty of oversight. Blaze's reaction and appeal deadline Foggo Entertainment, the company responsible for operating the Blaze brand, has ten days to file an administrative appeal after formally receiving notification of the decision. When contacted, the company stated that it does not comment on ongoing legal proceedings and declared that its activities and partnerships “are guided by strict compliance with the laws and regulations in force in the country.” In a separate statement, Foggo said that it “is constantly evolving and improving its internal processes and controls” and that it has “unrestricted respect for due process.” The team of influencer João Caetano did not comment by the time of publication of the original text. The case reached the Ministry of Finance through a complaint from the Alana Institute, an NGO dedicated to promoting the rights of children and adolescents. Action by the Public Prosecutor's Office Blaze is also the target of a public civil action by the Public Prosecutor's Office of the Federal District and Territories (MPDFT), filed on Thursday (July 8). The action points to misleading and abusive advertising, as well as other practices harmful to bettors. The MPDFT is asking the court to order the company to pay R$ 120 million for collective moral damages, with the funds being allocated to social programs aimed at treating gambling addiction.
