TITLE: Federal Deposit Insurance Corporation Establishes Coordinated Approach for Handling Highly Sensitive Information During Examinations

On July 16, 2026, the Federal Deposit Insurance Corporation (FDIC), the Board of Governors of the Federal Reserve System, and the Office of the Comptroller of the Currency (OCC) issued a joint supervisory statement establishing a coordinated federal banking agency approach for handling highly sensitive information during examinations of supervised institutions.
The statement applies to all FDIC-supervised financial institutions and clarifies how the agencies will protect and handle sensitive data in accordance with applicable confidentiality laws, regulations, and data security standards. Highly sensitive information includes confidential and proprietary data such as technology and network diagrams, detailed penetration test results, technical details of information technology control weaknesses, and succession planning documentation. If an institution's management believes certain information should be classified as highly sensitive, it should discuss its concerns with the assigned Examiner-In-Charge (EIC) or primary agency contact. The FDIC will then consider several options to preserve confidentiality, including on-site review, direct digital review from the supervised bank's systems, redacted or summarised versions of documents, or additional protective measures. The agencies have committed to ensuring this process does not interfere with the FDIC's ability to access information, conduct examinations, support conclusions, or maintain a historical record.
The agencies have also established a notification protocol for potential or confirmed material cybersecurity incidents (CSI). The affected agencies will notify impacted banks of a potential or confirmed material CSI compromise as soon as practicable and within no more than 72 hours, once the agency impacted has a reasonable basis to believe a compromise has occurred and determines which banks are affected, subject to applicable legal considerations.
