TITLE: Florida Office of Financial Regulation Resolves Compliance Matter with Axe Capital Lending LLC

On July 11, 2026, the Florida Office of Financial Regulation (OFR) entered a Final Order resolving an administrative enforcement action against Axe Capital Lending LLC and Eduardo A. Hernandez, the company's manager, sole owner, and principal loan originator. The OFR, which administers and enforces chapter 494, Florida Statutes (mortgage lending regulations), conducted an examination of the respondents to assess their compliance with state mortgage lending requirements.
The OFR found that Axe Capital Lending LLC, a mortgage lender licensee holding license number MLD2452, failed to timely file its Financial Audit Report (FAR) for the year ending December 31, 2024. The FAR was due on April 30, 2025, but the respondents did not submit it until December 11, 2025—225 days late—in violation of section 494.0063, Florida Statutes. Rather than pursue formal litigation, the parties resolved the matter through a Stipulation and Consent Agreement, which the OFR approved and incorporated into the Final Order.
Under the settlement terms, the respondents agreed to cease and desist from future violations of chapter 494, Florida Statutes, and to comply with all mortgage lending provisions and rules. The respondents also agreed to pay an administrative fine of $1,250, payable to the OFR by wire, cashier's check, or money order referencing Case Number 135139. By consenting to the Final Order, the respondents waived their right to an administrative hearing, appeal, and other procedural rights under chapter 120, Florida Statutes. The Final Order constitutes final agency action and may be enforced pursuant to chapters 120 and 494, Florida Statutes.
