The ordinances were expected to be published in the Official Gazette of the Union on July 10, 2026, though they did not appear in the regular edition and were anticipated to be published in an extra edition later that day.
Finance Minister Dario Durigan outlined the scope of the new rules, stating that all media outlets, television channels, radio stations, internet platforms, and commentators are subject to the advertising guidelines. The ordinances prohibit commentators and media personalities from inducing people to gamble through personal opinions or endorsements, such as suggesting a team will certainly win and generate betting profits. Durigan explained that the authority of commentators amplifies gambling inducement, leading to increased debt among consumers, and therefore the government does not support commentators encouraging gambling activity.
The announcement reflects broader enforcement efforts by Brazil's Finance Ministry targeting the online betting sector. To date, 56 betting websites, apps, and platforms have been removed from operation, and nearly 1,000 influencer profiles have been removed from social media. Almost one million individuals have voluntarily self-excluded from betting platforms. The ministry is enforcing a Supreme Federal Court (STF) ruling prohibiting beneficiaries of social programs, including Bolsa Família and BPC, from accessing betting platforms, affecting tens of millions of people. Additionally, predictive market platforms have been banned from operating in Brazil. Ricardo Morishita, National Consumer Secretary of the Ministry of Justice, confirmed that the National Consumer Protection System will collaborate to ensure compliance with existing regulations across state and municipal levels.
The ordinances represent an escalation in Brazil's regulatory approach to online betting advertising and consumer protection in the sector.
