The Secretariat for Prizes and Betting of the Ministry of Finance (SPA/MF) published, in the Official Gazette of the Union on Friday (June 30), two regulations that prohibit beneficiaries of the renegotiation of FIES (Student Financing Fund for Higher Education) debts from accessing fixed-odds betting platforms. The restriction covers both the opening of new accounts and the use of existing ones. The regulations are Normative Instruction SPA/MF No. 8 and Ordinance SPA/MF No. 1.638, both signed on Monday (June 26) by Secretary Daniele Correa Cardoso. The ordinance amends Ordinance SPA/MF No. 1.231, of Tuesday (July 31) 2024, adding FIES beneficiaries to the list of people prohibited from participating in betting. If the user does not withdraw the funds within this period, the operator must transfer them to a bank or payment account registered and maintained at an institution authorized by the Central Bank. Open bets at the time of identification must also be canceled, with a full refund of the amounts. In cases where direct reimbursement is not feasible—due to problems with the user's account, inability to contact the account holder, or refusal to provide a destination account—the operator must maintain accounting records of the amounts and continue attempting to contact the account holder. All communications with the user must be documented, including date, time, channel used, and message content, and stored for a minimum of five years. The restriction is temporary; it automatically ceases when the beneficiary's CPF (Brazilian taxpayer ID) is no longer listed in the SIGAP's (Integrated Account Management System) database. However, account reactivation depends on updating registration information and the absence of any other legal impediment. Deadlines and retroactivity The normative instruction establishes two critical deadlines from its publication. The first is ten days for operators to implement the described procedures. The second, of fifteen days, determines that betting houses consult SIGAP for all CPF numbers already registered on their platforms — and suspend the accounts of those who appear as ineligible. This retroactive screening is the most sensitive element of the regulation; it requires operators to actively identify already registered users who have become FIES beneficiaries after opening their account, and not just block new access. Context of the fence The ban on FIES beneficiaries is part of a broader list of restrictions that the SPA/MF has been building since July 2024. Ordinance No. 1.638 included this group in item X of article 8 of Ordinance No. 1.231, alongside other already prohibited categories, including: ⇒ Beneficiaries of the Bolsa Família Program and the Continuous Benefit Payment (BPC); ⇒ Beneficiaries of the Extraordinary Program for Financial Rebalancing of Families (Novo Desenrola Brasil), whose contracts are guaranteed by the Operations Guarantee Fund. The inclusion of FIES debtors on the list was supported by Resolution No. 66 of the FIES Management Committee, dated Friday (May 11) 2026, and is based on Article 5-A, paragraph 4-B, of Law No. 10.260, dated Tuesday (July 12) 2001. Failure to comply with the obligations set forth in the normative instruction will subject the operators to the sanctions provided for in SPA/MF Ordinances No. 1.225 and No. 1.233, dated Tuesday (July 31) 2024, pursuant to Articles 41 and 42 of Law No. 14.790, dated Tuesday (December 29) 2023. Betting operators must, without prejudice to other measures they deem appropriate, consult the Betting Management System – SIGAP to verify whether the user is listed in the database of beneficiaries of debt renegotiation with the Higher Education Student Financing Fund – FIES. Article 3. Consultations with the Betting Management System – SIGAP must be carried out in accordance with the rules contained in the Manual of the Ineligible Module, available at the electronic address https://www.gov.br/fazenda/pt-br/composicao/orgaos/secretaria-de-premios-e-apostas/sistema-de-gestao-de-apostas-sigap or at another address published by the Betting Prizes Secretariat. Article 4. Consultations with the Betting Management System – SIGAP must be carried out by betting operators, on a mandatory basis, when the user performs one of the following actions in the betting system: I - opening of registration; and II – first login of the day. Sole paragraph. The consultations foreseen in this article do not exclude the need for periodic consultations with the Betting Management System – SIGAP, already foreseen in other regulations of the Prizes and Betting Secretariat. Article 5. Access to the Betting Management System – SIGAP must be done using the user's Individual Taxpayer Registry number – CPF. Sole paragraph. The Betting Management System – SIGAP will return the query with the following information for the betting operator: I – “Ineligible – FIES Renegotiation”, when the Individual Taxpayer Registry number – CPF appears in the Ineligible Module database as belonging to a person benefiting from debt renegotiation with the Student Financing Fund for Higher Education – FIES; or II – “Not Impeded”, when the Individual Taxpayer Registry number – CPF is not found in the Impeded Module database. Article 6. The request to open an account in the betting system must be denied when the query to the Betting Management System – SIGAP returns the information “Blocked – FIES Renegotiation”. Article 7. Upon the first login of the day to the betting system, if the query returns the information "Blocked - FIES Renegotiation", the betting operator must suspend the account within three days from the date of the query. § 1 Before suspending a user's account, the betting operator must inform the user of the reason, via email, messaging applications, Short Message Service – SMS, or other available means, within a maximum period of one day from the date of the inquiry. § 2 The communication referred to in § 1 must inform the user of the possibility of voluntarily withdrawing funds in their name from the account within two days. § 3 If the user does not voluntarily withdraw the funds in their name from the account, the betting operator will make the refund as per article 8. § 4 The betting operator must document all communications with the user, recording the date, time, channel used and message content, and store this information for a minimum period of five years. Article 8. If the user identified as a beneficiary of the debt renegotiation with the Student Financing Fund for Higher Education – FIES has not withdrawn the funds from their account, the betting operator must, after suspending the account as per Article 7, return the funds within two days by transferring them to one of the deposit or payment accounts registered in the betting system and held at a financial or payment institution authorized by the Central Bank of Brazil. Sole paragraph. In the event that it is not possible to remit the funds as described above, including due to problems involving the user's deposit or payment account, inability to contact them, or their refusal to provide a deposit or payment account, the betting operator must: I – maintain accounting records of the resources mentioned in the heading; and II – to make efforts to contact the user as per article 7, § 1, so that they may indicate a deposit or payment account in their name at an institution authorized by the Central Bank of Brazil, through which they may receive the funds in their name. Article 9. If a user is identified as a beneficiary of debt renegotiation with the Student Financing Fund for Higher Education – FIES and has open bets, the betting operator must cancel them and make a full refund of the funds as per Article 8, if the user has not made the voluntary withdrawal referred to in Article 7, § 2. Article 10. The restriction on the use of the betting system applies exclusively while the user's Individual Taxpayer Registry number (CPF) is listed in the database of the Restricted Users Module of the Betting Management System (SIGAP). Sole paragraph. The betting operator may reactivate the account in the betting system, by updating the registration, of the user whose Individual Taxpayer Registry number (CPF) is no longer listed in the database of the Blocked Users Module referred to in this Normative Instruction, provided that there is no other legal impediment. Article 11. It is forbidden to consult or process data from the Ineligible Players Module of the Betting Management System – SIGAP for purposes other than those set forth in this Normative Instruction and other regulations issued by the Prizes and Betting Secretariat. Article 12. Betting operators must report, through the Betting Management System – SIGAP, with the status “Impeded – FIES Renegotiation”, the Taxpayer Identification Number – CPF of users prevented from registering or using the betting systems, in the form of the model published at the electronic address https://www.gov.br/fazenda/pt-br/composicao/orgaos/secretaria-de-premios-e-apostas/sistema-de-gestao-de-apostas-sigap, within a maximum period of fifteen days, after updating the data model with the inclusion of this functionality, which will be communicated by the Secretariat of Prizes and Betting. Sole paragraph. As long as there are funds in the transactional account belonging to the user identified as a beneficiary of the debt renegotiation with the Student Financing Fund for Higher Education – FIES, as addressed in this Normative Instruction, the betting operator must maintain the status “Suspension – FIES Renegotiation” registered in the Betting Management System – SIGAP, and inform the Prizes and Betting Secretariat, as per the main clause. Article 13. Betting operators must implement the procedures set forth in this Normative Instruction within a period of up to ten days from its publication. Article 14. Within fifteen days from the date of publication of this Normative Instruction, betting operators must consult the Ineligible Entities Module of the Betting Management System – SIGAP for all Individual Taxpayer Registry – CPF numbers registered in their betting systems, to verify if any user appears in the database of beneficiaries of debt renegotiation with the Student Financing Fund for Higher Education – FIES. Sole paragraph. If the query returns the information “Blocked – FIES Renegotiation”, the betting operator must suspend the user's account, as per article 7. Article 15. Failure to comply with the duties set forth in this Normative Instruction will result in the application of Ordinance SPA/MF No. 1.225, of July 31, 2024, and Ordinance SPA/MF No. 1.233, of July 31, 2024, as applicable, pursuant to Articles 41 and 42 of Law No. 14.790, of December 29, 2023. Article 16. This Normative Instruction enters into force on the date of its publication.
