TITLE: Indonesia's Bank Indonesia Amends Export Foreign Exchange and Import Payment Rules BODY: On June 29, 2026, Bank Indonesia published Regulation of Governing Board Members Number 16 of 2026 (PADG 16/2026), which amends export foreign exchange (DHE) and import payment foreign exchange regulations. The regulation became effective on June 1, 2026. PADG 16/2026 implements changes to align with amendments to Government Regulation Number 36 of 2023 on export foreign exchange from natural resource activities, most recently modified by Government Regulation Number 21 of 2026. Bank Indonesia also issued Bank Indonesia Regulation Number 5 of 2026 to reflect these adjustments. The amendments to PADG Number 4 of 2023 address implementation requirements across multiple areas. Key changes include restricting deposit and placement of natural resource export foreign exchange to state-owned banks only; clarifying placement obligations for oil and gas sectors (minimum 30 percent for at least three months) and non-oil and gas sectors (100 percent for at least 12 months); limiting banking placement instruments to state-owned bank instruments while removing non-bank financial institution instruments; and adding government securities (SUN) and Islamic government securities (SBSN) issued in foreign currency on the domestic primary market as permitted placement instruments. The regulation restricts non-oil and gas export foreign exchange conversion to rupiah to state-owned banks only and establishes maximum conversion limits. It expands permitted fund transfer sources to the export foreign exchange account, adds foreign exchange purchase provisions for meeting export foreign exchange obligations, and restricts bank obligations related to export foreign exchange to state-owned banks only. The regulation also enhances Bank Indonesia's supervisory authority over non-oil and gas resource exporters regarding placement compliance and maximum conversion limits, adjusts Bank Indonesia's supervision mechanisms for exporters failing to meet deposit and placement obligations, and adds provisions for bilateral trade agreement implementation.
