TITLE: Brazil's Monetary Council Issues Resolution on Blocking Accounts of Unauthorised Betting Operators

On June 25, 2026, Brazil's National Monetary Council (Conselho Monetário Nacional — CMN) approved Resolution 5320, which mandates the blocking of accounts and prevention of financial transactions for individuals and entities operating fixed-quota lottery betting without authorisation under Brazilian law.
The resolution implements provisions from Law 15,358 (the Legal Framework for Combating Organised Crime in Brazil), published on March 24, 2026, and Decree 13,033, issued on June 19, 2026. The Secretariat for Prizes and Betting (Secretaria de Prêmios e Apostas — SPA) within Brazil's Ministry of Finance holds authority to issue irregularity findings when unauthorised fixed-quota lottery betting operations are detected. Following such findings, the SPA notifies financial institutions and payment service providers of illegal operators requiring account blocking.
The resolution requires all financial institutions and payment institutions participating in Brazil's Payment System to block all deposit accounts, savings accounts, prepaid payment accounts, and settlement accounts within 24 hours of receiving the SPA's blocking notification. Once blocked, funds become unavailable. The resolution also mandates rejection of transactions to these accounts where funds are detected as being destined, directly or indirectly, for betting activities.
Accounts may be unblocked following a final administrative decision favouring the account holder in forfeiture proceedings, after conversion of blocked funds into judicial deposits. If a court decision confirms forfeiture, institutions must close the accounts. Forfeited amounts transfer to the National Public Security Fund under the Ministry of Justice and Public Security.
The resolution enters into force on August 28, 2026.
