The violation involved FanDuel accepting wagers on National Football League (NFL) regular season award markets after the Commission's approved deadline. Missouri's catalog of approved events permits NFL regular season award wagers only if placed before 1:00 p.m. eastern time on January 4, 2026, the day before the final regular season games. FanDuel's system inadvertently remained configured to accept such wagers for the entire day, resulting in 94 wagers totalling $4,690.37 placed after the deadline until 8:04 p.m. eastern time on January 4, 2026. FanDuel voided all affected wagers on January 20, 2026. The MGC issued a Notice of Investigation on February 24, 2026, and FanDuel acknowledged the violations on March 4, 2026, accepting full responsibility for the system error.
The settlement resolves violations of Article III, Section 39(g) of the Missouri Constitution and regulations 11 CSR 45-20.340 and 11 CSR 45-20.360, which prohibit licensees from accepting wagers on events or in forms not approved by the Commission. Under the settlement terms, FanDuel waives its right to a hearing before the Administrative Hearing Commission and agrees to comply with all MGC operational requirements and cooperate fully with future investigations.
