TITLE: Netherlands Gambling Authority Imposes Enforcement Action and Penalties on Chestoption Sociedad de Responsibilidad Limitada

On December 18, 2024, the board of the Kansspelautoriteit (KSA), the Netherlands gambling regulator, imposed a conditional penalty order on Chestoption Sociedad de Responsibilidad Limitada for breaching an earlier enforcement directive. The KSA determined that Chestoption violated the imposed order and that penalty payments totalling €840,000 were automatically forfeited under law.
Following the operator's failure to pay the forfeited penalties, the KSA initiated collection proceedings on September 5, 2025. The collection decision became final and binding after the expiry of the objection period without challenge. On June 9, 2026, the KSA issued a formal penalty decision against Chestoption, detailing the enforcement action and the basis for the sanctions imposed. The KSA simultaneously issued a public disclosure decision on the same date, making the penalty determination publicly available.
The enforcement action reflects the KSA's continued oversight of gambling operators operating in or targeting the Dutch market. Both the penalty decision and the disclosure decision remain subject to objection procedures under Dutch administrative law, allowing Chestoption to formally challenge the determinations. The collection decision, however, is now final and enforceable. The case demonstrates the KSA's approach to enforcing compliance with regulatory directives through escalating enforcement measures, including conditional penalties and collection action where operators fail to meet their obligations.
