TITLE: Croatia Enacts Law Implementing European Union Regulation on Over-the-Counter Derivatives

On June 9, 2026, the Croatian Parliament (Hrvatski sabor) enacted the Law on the Implementation of Regulation (EU) No. 648/2012 on Over-the-Counter Derivatives, Central Counterparties and Trade Repositories, published in the Official Gazette (Narodne novine) Issue 59/2026, Document Number 726.
The law transposes European Union Regulation (EU) No. 648/2012 into Croatian legal framework, establishing requirements for over-the-counter (OTC) derivatives markets, central counterparty (CCP) operations, and trade repository functions. This implementation aligns Croatia's regulatory regime with EU standards governing derivative instruments traded outside regulated exchanges, the role of central counterparties in mitigating counterparty risk, and the reporting and transparency obligations for market participants using trade repositories.
The enactment of this law ensures Croatia maintains compliance with EU financial services directives and strengthens the regulatory oversight of OTC derivatives markets within the country. The legislation applies to financial institutions, investment firms, and other market participants engaged in OTC derivative transactions, central counterparties operating within Croatia, and operators of trade repositories. The law came into effect upon publication in the Official Gazette on June 9, 2026.
