TITLE: European Commission Issues June Infringement Decisions Against Member States for Non-Compliance with EU Law BODY: On June 3, 2026, the European Commission (EC) announced its regular package of infringement decisions targeting Member States that have failed to comply with their obligations under EU law. The package encompasses enforcement actions across ten policy areas, including environment, internal market, migration and home affairs, justice, energy and climate, taxation, mobility and transport, financial services, jobs and social rights, and anti-fraud. The Commission initiated enforcement procedures through letters of formal notice, reasoned opinions, and referrals to the Court of Justice of the European Union (CJEU). Key actions include: sending a reasoned opinion to Spain for failing to correctly transpose the Seveso III Directive (Directive 2012/18/EU) on industrial accident prevention; issuing an additional reasoned opinion to Austria regarding insufficient transposition of the Aarhus Convention on environmental access to justice; and referring Ireland to the CJEU for non-compliance with the Environmental Impact Assessment Directive regarding peat cutting projects. In the financial services sector, the Commission sent a letter of formal notice to France for failing to adopt implementing measures on penalties under the Instant Payments Regulation (Regulation (EU) 2024/886). Additional enforcement actions targeted multiple Member States for incomplete transposition of directives governing energy efficiency, renewable energy permitting, emissions trading systems, and sustainable aviation fuels. The Commission closed 59 cases where Member States resolved identified compliance issues. Member States receiving letters of formal notice or reasoned opinions have two months to respond and address shortcomings. Failure to comply may result in referral to the CJEU with requests for financial sanctions. The EC maintains an interactive infringement decisions register providing case histories and enforcement activity tracking.
