TITLE: Maine Gambling Control Unit Establishes Fantasy Contest Operator Licensing Requirements and Responsible Wagering Standards

The Maine Gambling Control Unit established comprehensive licensing and operational requirements for fantasy contest operators through two regulatory chapters effective June 13, 2021. Chapter 35 sets out detailed application procedures and internal control standards, while Chapter 35-A establishes mandatory responsible wagering program requirements.
Under Chapter 35, fantasy contest operator applicants must submit completed application forms to the director specifying their principal place of business, designated contact person, and complete disclosure of ownership interests. Applicants with five percent or more ownership stakes must provide full identifying information, including names, addresses, dates of birth, and telephone numbers. Applicants must also submit three years of audited financial statements, certificates of authority, trade name registrations, and notarized authorizations for criminal background checks on applicants, officers, directors, and significant shareholders.
Critically, applicants must propose comprehensive internal controls addressing account verification, contestant deposit protection, fraud prevention, beginner contestant safeguards, and contest integrity. Internal controls must prevent unauthorized account withdrawals, detect proxy server misuse, verify contestant location, and prevent highly experienced contestants from accessing beginner-only contests. Operators must limit contestant entries per contest based on contest size, ranging from one entry in contests with 12 or fewer participants to three percent of all entries in contests exceeding 100 participants. The director must approve all internal controls prior to licensure.
Chapter 35-A requires operators to maintain responsible wagering programs including universal exclusion lists allowing individuals to self-exclude for one, three, five years, or lifetime. Operators must implement account restrictions on wagering amounts, wagering time, deposit amounts, and session duration. Operators must display responsible wagering information prominently on websites and mobile applications, including the 1-800 GAMBLER helpline, and provide annual employee training on identifying signs of gambling addiction.
