TITLE: Brazil's Ministry of Finance Requires Betting Operators to Block Desenrola 2.0 Program Beneficiaries
BODY:
On May 5, 2026, Brazil's Ministry of Finance published Normative Instruction SPA/MF No. 3, requiring fixed-odds betting operators to prevent participants in the Extraordinary Program for Financial Rebalancing of Families – Novo Desenrola Brasil (Desenrola 2.0) from registering and using their platforms.
The instruction, signed by substitute Secretary of Prizes and Bets Fabio Augusto Macorin, mandates that operators implement blocking procedures within ten days via the Betting Management System (SIGAP). Operators must conduct checks using users' Individual Taxpayer Registry numbers (CPF) during account opening attempts and at first login to identify beneficiaries listed in the program's database. When a CPF is identified as belonging to a Desenrola 2.0 beneficiary, the SIGAP system will return an "Impeded – Novo Desenrola Brasil Program" response, and the operator must deny account creation or suspend existing accounts within three days of identification.
Operators must notify affected users within one day of suspension, informing them of the reason and providing a two-day window for voluntary fund withdrawal. If users do not withdraw funds voluntarily, operators must return the money within two days to registered deposit or payment accounts. For users with open bets, operators must cancel them and provide full refunds. Operators must document all communications with users, retaining records for a minimum of five years. Account reactivation is permitted once a user's CPF is removed from the Blocked Users Module database and no other legal impediment exists. Within fifteen days of publication, operators must conduct an initial review of all CPF numbers in their systems to identify existing Desenrola 2.0 beneficiaries. Non-compliance will result in sanctions under Law 14.790 (December 29, 2023). The normative instruction took effect upon publication.

Companies may adopt any additional measures they deem necessary to comply with this regulation. Verification in SIGAP will be done using the user's Individual Taxpayer Registry number (CPF). When the CPF is listed in the Impeded Module database as belonging to a beneficiary of the program, the response will be "Impeded – Novo Desenrola Brasil Program". If the CPF is not registered in the Impeded Module database, the system will report "Not Impeded". When the query returns an "impediment" message during an attempt to open an account, the request should be denied by the operator. The block prevents the program beneficiary from creating a new account on the betting platform. If the consultation carried out in the first login From the date the impediment information is returned, the operator will have up to three days to suspend the account. When it is impossible to transfer funds, including due to problems involving the user's deposit or payment account, inability to contact the user, or refusal to provide an account, the operator must maintain accounting records of the amounts. The company must make efforts to contact the user, requesting that they provide a deposit or payment account in their name at an institution authorized by the Central Bank to receive the funds.
