The funds must be transferred to one of the deposit or payment accounts registered in the betting system and held at a financial or payment institution authorized by the Central Bank of Brazil. When it is impossible to transfer funds, including due to problems involving the user's deposit or payment account, inability to contact the user, or refusal to provide an account, the operator must maintain accounting records of the amounts. The company must make efforts to contact the user, requesting that they provide a deposit or payment account in their name at an institution authorized by the Central Bank to receive the funds. For users identified as beneficiaries of the Novo Desenrola Brasil program who have open bets, the operators must cancel them and provide a full refund of the funds. This refund follows the same established procedures as if the user did not make a voluntary withdrawal within two days. The restriction on using the betting system applies exclusively while the user's CPF number (Brazilian taxpayer ID) is listed in the SIGAP's Blocked Users Module database. The operator may reactivate the account by updating the registration information when the CPF is no longer listed in the Blocked Users Module database, provided there is no other legal impediment. Reactivation depends on a new query to the system. It is forbidden to consult or process data from the Ineligible Players Module of the Betting Management System for purposes other than those specified in this rule and other regulations issued by the Prizes and Betting Secretariat. Operating agents must report this information through SIGAP, with the professional status “Suspension – Novo Desenrola Brasil Program”, the CPF (Brazilian taxpayer ID) of users prevented from registering or using the betting systems. The maximum period is fifteen days after the data model is updated to include this functionality, which will be communicated by the Prizes and Betting Secretariat. If the query returns the information "Blocked – Novo Desenrola Brasil Program," the operating agent must suspend the user's account. The suspension procedure must follow the established rules, including prior notification to the user and a deadline for voluntary withdrawal of funds. Failure to comply with the duties stipulated in the normative instruction will result in the application of ordinances 1.225 and 1.233, both of July 31, 2024, as applicable. The sanctions are outlined in articles 41 and 42 of Law 14.790, dated December 29, 2023. The normative instruction came into effect on the date of its publication.
