Key amendments include expanding the definition of qualifying health conditions to explicitly include oncological disease, HIV, diabetes, and hepatitis C. The law extends the right to be forgotten to both residential mortgage credit and consumer credit, as well as mandatory and optional insurance associated with these credits. Individuals who have overcome or mitigated serious health risks or disabilities are protected from discrimination in credit access and insurance contracting. For life insurance required by lenders, the law restricts mandatory coverage to death risk only, though additional coverage for disability or incapacity may be proposed to reduce commissions or other contract costs. Borrowers may substitute life insurance with alternative guarantees including mortgages on other properties or sureties. For married couples or those in de facto unions where one member has a disability exceeding 60 percent, life insurance may be required only from the non-disabled member. The law establishes a data-sharing protocol between the Institute of Registries and Notaries and insurance supervisory authorities to facilitate death certificate notifications, subject to prior approval from the National Data Protection Commission. The law took effect upon publication on April 27, 2026.
