TITLE: India's Reserve Bank Issues Master Direction on Counterfeit Banknote Detection, Reporting and Monitoring BODY: On April 3, 2023, the Reserve Bank of India (RBI) issued a Master Direction on Counterfeit Notes, 2023, consolidating and updating existing guidelines on counterfeit banknote detection, reporting and monitoring for all banks operating in India. The direction was issued under the authority of Sections 35A and 56 of the Banking Regulation Act, 1949. The Master Direction establishes comprehensive procedures for detecting, impounding, and reporting counterfeit banknotes. Banks must examine all banknotes tendered over counters and received at back offices using machine authentication. Counterfeit notes detected must be stamped "COUNTERFEIT NOTE" and impounded in a prescribed register. Banks are prohibited from returning counterfeit notes to tenderers or destroying them; failure to impound detected counterfeits is construed as wilful involvement in circulation. Acknowledgement receipts in prescribed format must be issued to all tenderers of counterfeit notes. The direction requires banks to establish Forged Note Vigilance (FNV) Cells at head office level to disseminate RBI instructions, monitor implementation, compile detection data, and coordinate with police authorities. For counterfeit note detections up to four pieces in a single transaction, banks must submit consolidated monthly reports to police. Detections of five or more pieces require immediate filing of First Information Reports (FIRs). Banks must equip all branches and currency chests with note sorting machines, ultraviolet lamps, and other detection devices conforming to RBI guidelines. Monthly reports on counterfeit note detection must be submitted to the concerned RBI Issue Office by the 7th of the following month. Data must also be reported to the Financial Intelligence Unit-India (FIU-IND) and National Crime Records Bureau (NCRB) under applicable money laundering prevention rules.
