TITLE: Ukraine's National Bank Imposes Fine and Written Warning on Financial Company

On March 30, 2026, the National Bank of Ukraine (NBU) imposed enforcement measures against LLC "Smartiway Ukraine" (registration number 42038225), comprising a fine of 11,641,600 Ukrainian hryvnia and a written warning. The Committee on Supervision and Regulation of Non-Banking Financial Services Markets adopted these measures following a scheduled inspection conducted by the NBU's Inspection Department.
The fine was imposed for violations of several Ukrainian laws and regulations, including the Law on Consumer Credit, the Law on Financial Services and Financial Companies, the Law on the Organisation and Circulation of Credit Histories, and provisions governing consumer credit service delivery, loan agreements, and ethical conduct requirements when managing overdue debt. The written warning addressed separate violations of the Law on Consumer Credit, provisions on licensing and registration of financial service providers, and authorisation requirements for financial service providers.
LLC "Smartiway Ukraine" is required to pay the fine within one month from the date the decision takes effect. The company must also take corrective measures by April 30, 2026, to prevent future violations identified in the warning. Administrative acts adopted by the NBU take effect from the date they are communicated to the financial company through established procedures, with the communication date being the date the act is sent by post.
