TITLE: Austria Enacts Sustainability Reporting Law Implementing European Directive
BODY:
On February 18, 2026, Austria enacted the Sustainability Reporting Law (Nachhaltigkeitsberichtsgesetz – NaBeG), implementing European Directive 2022/2464 into Austrian law. The law was adopted by the National Council on January 21, 2026, and subsequently approved by the Federal Council on February 5, 2026.
The NaBeG establishes mandatory sustainability reporting requirements for certain undertakings operating in Austria. The legislation amends multiple existing Austrian laws to incorporate sustainability reporting obligations, including the Corporate Code (Unternehmensgesetzbuch), Stock Corporation Act (Aktiengesetz), Limited Liability Company Act (GmbH-Gesetz), Cooperative Act (Genossenschaftsgesetz), and financial sector legislation including the Banking Act (Bankwesengesetz), Stock Exchange Act 2018 (Börsegesetz 2018), Investment Funds Act 2011 (Investmentfondsgesetz 2011), Insurance Supervision Act 2016 (Versicherungsaufsichtsgesetz 2016), and the National Bank Act 1984 (Nationalbankgesetz 1984).
The law also amends the Third Country Undertaking Reporting Act, establishing reporting requirements for non-EU companies operating within Austrian jurisdiction. Additional amendments address auditor oversight, alternative investment fund managers, and related regulatory frameworks.
The NaBeG represents Austria's transposition of the Corporate Sustainability Reporting Directive (CSRD), which expands sustainability disclosure requirements across the European Union. The law applies to large undertakings and certain financial institutions, requiring them to report on environmental, social, and governance matters in accordance with European sustainability standards.
The legislation is now in force as published in the Austrian Federal Law Gazette (Bundesgesetzblatt) I No. 6/2026.
